Terms & Conditions

1. Acceptance of Terms


By accessing or using services from RCA Global Logistics Ltd. ("Company"), you agree to be bound by these Terms. If engaging on behalf of an organization, you confirm authority to bind said entity. Services are available only to persons aged 18+.



2. Service Scope


2.1 We provide:

  • Freight forwarding (air/sea/road)
  • Customs clearance & trade compliance
  • Warehousing & inventory management
  • Supply chain solutions


2.2 All services subject to:

  • Kenyan Companies Act (2015)
  • East African Community Customs Management Act
  • Kenya Revenue Authority (KRA) regulations

3. User Obligations


3.1 Clients must:

  • Provide accurate shipment details (weight, dimensions, HS codes)
  • Submit valid documentation 48hrs pre-clearance
  • Declare dangerous/hazardous materials

3.2 Prohibited items include:

  • Illegal substances per Kenyan law
  • Counterfeit goods
  • Unprocessed minerals without Ministry of Mining permits

4. Payment Terms


4.1 Fees calculated based on:

  • CBM (Cubic Meters) or gross weight (chargeable weight)
  • Fuel surcharges & currency fluctuations
  • Expedited service premiums

4.2 Invoices payable within 14 days. Late payments incur 2% monthly interest.


5. Liability & Insurance


5.1 Our liability capped at:

  • KES 5,000 per kg for air freight (Montreal Convention)
  • KES 150,000 per container for sea freight (Hague-Visby Rules)

5.2 Full liability requires:

  • Purchase of All-Risk Marine Insurance
  • Immediate notification of damage (≤24hrs post-delivery)

6. Force Majeure

Not liable for delays/cancellations due to:

  • Port strikes
  • Political unrest
  • COVID-19-style pandemics
  • Acts of God (floods, earthquakes)

7. Dispute Resolution


7.1 First attempt mediation through:

  • Chartered Institute of Arbitrators (Kenya Chapter)

7.2 Unresolved disputes governed by:

  • Laws of Kenya
  • Exclusive jurisdiction of Nairobi courts

8. Intellectual Property

All logistics software, routing algorithms, and operational methodologies remain Company property. Client data protected per Kenya's Data Protection Act (2019).


9. Termination

We may suspend services for:

  • Non-payment beyond 30 days
  • False declarations
  • Repeated customs violations

10. Amendments

Terms updated periodically. Continued use after 30-day notice constitutes acceptance.
